‘해외건설 실무회화’ 집필자 방재영 대표이사((주)영인터내셔널)는 건설교통부(現 국토교통부) 해외건설과장을 역임하는 등 해외건설 업무에 능통한 전문가로 퇴임후에도 해외건설협회 이사 동아건설 해외사업본부장 등을 역임했습니다.

■Manner of Execution ;공사수행 방법
A : How is the manner of execution by the contractor specified in the construction contracts?
B : Generally, the manner of execution for the construction works by the contractor is specified in the contract documents (mainly in the general conditions of contract), typically quoted as : "Contractor shall carry out his work in a workmanlike and careful manner, and in accordance with recognized good practice."
A : However, phrases such as "proper workmanship and careful manner" or "recognized good practice and quality of materials" are not precise and difficult to judge, aren't they?
B : You are right. Therefore, these phrases(requirements) will have to be interpreted by the engineer in accordance with 'Quality of Materials' and 'Standard of Workmanship' specified in the contract documents and/or the National Standard Specifications of the country of the project in relation to the actual goods that are supplied and work that is executed by the contractor.
A : 시공업자의 공사수행 방법은 건설계약에서 어떻게 규정되어 있나요?
B : 일반적으로 시공업자에 의한 공사수행 방법은 계약문서(주로 계약일반조건)에 통상적으로 다음과 같이 규정하고 있습니다.
“계약자(시공업자)는 장인정신과 주의 의무를 다하고 일반적으로 인정되는 양호한 관행에 따라 공사를 수행하여야 한다”
A : 그러나 “적절한 장인정신(작업기술)과 주의의무를 다하는 자세” 또는 “일반적으로 인정되는 양호한 관행과 자재의 품질”이라는 문구는 명확치 않고 판단하기가 어렵지 않습니까?
B : 네, 그렇습니다. 그래서 이같은 문구(조건)들은 최종적으로 공사감독이 해석 또는 판단하게 되는데, 공감독은 계약문서에 규정된 ‘자재의 품질’과 ‘공법표준’ 및 공사가 수행되는 국가의 시방표준 등에 근거, 시공업자에 의해서 실제로 반입된 물품과 시공된 공사와 관련해서 이를 해석하고 판단하는 것입니다.
(1) Manner of Execution : 일반적으로 manner는 방법, 방식, 태도, 자세 등으로 번역되나 공사시공과 관련해는 시공업자의 시공자세 및 태도라는 뜻이 강하다(시공업자의 일반적 의무사항).
(2) National Standard Specifications (국가표준시방) : KS(한국), ASTM(미국), JIS(일본), DIN(독일) 등이 있다.
